What it is

The official record of a hearing in which the rapporteur asked Microsoft France's legal director whether he could guarantee, under oath, that data of French citizens entrusted to Microsoft through the public purchasing body UGAP "ne seront jamais transmises, à la suite d'une injonction du gouvernement américain, sans l'accord explicite des autorités françaises". The answer: "Non, je ne peux pas le garantir, mais, encore une fois, cela ne s'est encore jamais produit" (No, I cannot guarantee it, but, once again, this has never yet happened). The witness described the process for contesting requests the company considers unfounded, and stated that requests it is legally compelled to honour must be complied with, while it tries to notify the customer.

Role in the record

  • Context for the BP11 governance tab: a US provider's own legal director confirms, on the record, that EU hosting does not remove the reach of US legal process. It is the practical counterpart of the EDPB-EDPS CLOUD Act assessment.
  • Limits: the hearing concerns a general cloud suite sold to the French public sector, not an AI service, and one provider. The point transfers to any service run by a provider under US jurisdiction; the record does not extend it further than that.
